01Agreement to these terms
These Terms of Use (“Terms”) govern your use of kivanoo.com (the “Website”), operated by Kivanoo (“Kivanoo”, “we”, “us”). By using the Website you agree to these Terms. If you do not agree, please do not use the Website.
These Terms are an electronic record under the Information Technology Act, 2000 and do not require a physical or digital signature.
02About the Website
The Website describes Kivanoo, the products we build and operate, and the services we offer: digital product development, AI-powered websites, automation and related work. Information on the Website is general and is not an offer capable of acceptance.
03Acceptable use
You agree not to:
- use the Website in any way that breaks the law or infringes anyone's rights;
- attempt to gain unauthorised access to the Website, its servers or any connected system;
- introduce malware, or interfere with the Website's operation, security or performance;
- send spam, automated submissions or misleading information through our contact form;
- scrape or copy the Website in bulk, or use it to build a competing product; or
- impersonate Kivanoo or suggest an endorsement or partnership that does not exist.
04Intellectual property
The Website and everything on it, including text, design, graphics, interface visuals, code, the Kivanoo name and logo, and product names such as Examzio, belong to Kivanoo or its licensors and are protected by intellectual property laws.
You may view and share links to the Website for personal or internal business purposes. You may not copy, modify, distribute or reuse substantial parts of it without our written permission. Names and logos of third-party technologies mentioned on the Website belong to their respective owners and are used only to describe the tools we work with.
05Enquiries, proposals and engagements
Sending us an enquiry does not create a contract or a client relationship. Any work we do for you is governed by a separate written agreement, which takes priority over these Terms.
Please do not send confidential information through the contact form before we have agreed on confidentiality in writing. We are happy to sign a non-disclosure agreement before detailed discussions.
Estimates, timelines and examples discussed before a signed agreement are indicative only.
06Kivanoo products
Products built and operated by Kivanoo, such as Examzio, are described on the Website for information. Products marked “in development” or “under development” may change, be delayed or not be released. When you use a product, its own terms and privacy policy apply.
07Feedback
If you send us ideas or feedback about the Website or our products, you allow us to use them without obligation to you. This does not apply to material you share under a confidentiality agreement or a client contract.
08Third-party links and services
The Website may link to sites and services we do not control. We are not responsible for their content, availability or practices, and a link is not an endorsement.
09Disclaimer
The Website is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties, express or implied, that the Website will be uninterrupted, error-free or secure, or that information on it is complete or current. Nothing on the Website is professional, legal or financial advice.
10Limitation of liability
To the fullest extent permitted by law, Kivanoo is not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, data or goodwill, arising from your use of, or inability to use, the Website.
Because the Website is provided free of charge, our total liability to you for any claim relating to the Website is limited to INR 5,000. Nothing in these Terms limits liability that cannot be limited under applicable law, including for fraud.
11Indemnity
You agree to indemnify Kivanoo against claims, losses and reasonable costs, including legal fees, arising from your breach of these Terms or your misuse of the Website.
12Privacy
Our Privacy Policy explains how we handle personal data and forms part of these Terms.
13Changes to the Website and these Terms
We may change, suspend or withdraw any part of the Website at any time. We may also update these Terms; the date at the top of this page shows the latest version. Continuing to use the Website after an update means you accept the updated Terms.
14Governing law and disputes
These Terms are governed by the laws of India. If a dispute arises, please contact us first so we can try to resolve it informally within 30 days.
If it cannot be resolved informally, the courts of competent jurisdiction in India will have exclusive jurisdiction. If you are a consumer, this does not take away any mandatory protection you have under the laws of the country where you live.
15General
If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a right is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours as part of a reorganisation, merger or sale of our business. These Terms, together with the Privacy Policy, are the entire agreement between you and Kivanoo about the Website.
